Technology in the Practice and Workplace

Is it a violation of an employee's privacy to read her e-mail? Can a union use the employer's e-mail system for solicitation, distribution, and/or organization? Can you legally track an employee's whereabouts with the use of GPS technology? Can an employer be held responsible for the safety of an employee who telecommutes from home? Can an attorney secretly tape conversations with opposing counsel or advise his client to tape meetings with his supervisor? What are an attorney's obligations with respect to preservation and production of electronic discovery? As these questions illustrate, technology has infiltrated almost every aspect of labor and employment law, both substantively and in its practice.

Because of the tremendous influence of technology in the workplace, the Section created the Technology Committee in May 2000. The Committee focuses on three areas: (1) examining the impact of technology on substantive labor and employment issues; (2) exploring the impact and use of technology on the practice of law; and, (3) serving as a resource to Section members.

Dear Members,

Now, this may all sound a bit soppy. However, we have just returned from our International Legal Exchange (ILEX) briefing trip to the Republic of Korea, Japan, and the People's Republic of China, including the Hong Kong Special Administrative Region. Three countries, four systems, five cities in eleven days. And those in our delegation will know what I mean when I describe the excursion as, quite simply, the trip of a lifetime. We listened, we learned, we exchanged views, we felt enriched, we were extraordinarily well-received and well-hosted by lawyers and judges everywhere we went, and we climbed the Great Wall of China!

The journey began in South Korea, where ABA International had the opportunity to memorialize a friendship accord with the Korean Bar Association International Committee. Over the course of the remainder of our trip, we also held productive meetings and social events with, among others, the Japan Federation of Bar Associations, the All China Lawyers Association and the China Law Society, all in furtherance of the Memoranda of Understanding that exist between each of these groups and the larger ABA. We also met for the first time with the Shanghai Bar Association and its new leadership, spending the better part of the day contemplating with them future collaboration and projects of mutual interest. Finally, at our last luncheon, hosted by the Law Society of Hong Kong, we were treated to remarks by Chief Justice Andrew Li of the Hong Kong Court of Final Appeal, our keynote speaker. When the delegation sailed off into the sunset that evening, on a perfectly clear night in Hong Kong harbor aboard the Allen & Overy junk, it was an inspired, if somewhat exhausted, group.

There are so many people to thank for such an ambitious and successful venture. For a start, what a great delegation! And special thanks to Section staffer extraordinaire, Christina Heid, our International Projects Director, whose year of planning (and conference calls often at unsociable hours to link up with the Far East) in preparation for this visit paid huge dividends, as did Christina's "cat-herding" skills when getting the delegation on and off airplanes and in and out of our meetings.

Our ranks swelled a bit when we reached Japan, where those joining the delegation included our Chair-Elect Aaron Schildhaus and Vice-Chair Glenn Hendrix, both of whom had just learned, as Dave Barry once told us, that flying from the United States to Tokyo "takes about as long as law school", and by others who had participated in the World Justice Forum in Vienna, among them the Honorable Stephen G. Breyer, Associate Justice of the Supreme Court of the United States, and his wife, Joanna.

Not for the first time, Justice Breyer enhanced and transformed an ILEX trip by his active participation in it. He impressed upon us the importance of lawyers from around the world meeting in this way, and of our attempting to define issues and seeking to find or create answers. We want to thank Justice Breyer for the many conversations he shared with members of our delegation and those with whom we met. There is in fact an old Asian proverb which says that a single conversation with a wise man is better than 10 years of study. On that basis, we probably owe Justice Breyer the equivalent of enough study for a few more degrees — and without any student loans as part of the bargain!

I would also like to extend personal thanks to Steve Zack, our distinguished Council member and former Chair of the ABA House of Delegates, who did a spectacular job stepping in at the last moment for ABA President Bill Neukom when it turned out that Bill could not make the event. Steve is standing unopposed for the position of President-Elect of the ABA and will make a great(!) ABA President. My appreciation also extends to Akira Kawamura, Secretary General of the International Bar Association, for the stunning way in which he welcomed the leadership of the delegation. A good friend of the Section, it will be our privilege to support Akira in the run-up to, and during, his term as President of the IBA.

Thus, another chapter is written, but it is an episode at best in a rich 130-year history (see below), and there is much more of the story of ABA International, this remarkable collective enterprise, still to write. So, grab a Section pen — we'll provide these — and join us, August 6–7, for the Section Leadership Advance (a.k.a. “the Retreat”) at Bally's, on the corner of Boardwalk and Park Place in Atlantic City, New Jersey. An opportunity to plan, strategize and make a difference before we jump on the bus to the next big, and final, event on the Section calendar for this ABA year: the 2008 ABA Annual Meeting, August 7–12, in New York City. Think "World Class".

The Section will be headquartered for the Annual Meeting at the five-star Waldorf=Astoria Hotel. We’ll launch the weekend in the hotel’s Starlight Room with our traditional Friday night Welcome Reception from 6:00 to 7:30 p.m. Jointly sponsored with the Section of Intellectual Property and the Section of Science and Technology, this not-to-be-missed event will offer magnificent views of New York City and countless networking opportunities with the members of all three Sections. Our CLE programs — and several that we’re co-sponsoring — will take place at the ABA CLE Center at the Sheraton New York August 8–10. We’ll host a Presidential Showcase Program at the Hilton New York entitled “Individual Rights, Terrorism and the Rule of Law: The World After 9/11,” on Friday, August 8, from 10:30 a.m. to 12:00 p.m., and we’ll co-sponsor a second Showcase Program on Saturday from 10:30 a.m. to 12:00 p.m. entitled “The Universal Declaration of Human Rights at 60: Advancing Human Rights in a Dangerous World.” Click here to learn more about our CLE lineup. In addition, as we saw at our Spring Meeting, there is no better place for world-class entertainment, restaurants, and sightseeing than New York City.

Temptation aplenty. However, and most importantly, plan to spend Saturday night, August 9, at an exceptional black tie (optional) reception and dinner at the New York Yacht Club from 7:00 to 10:30 p.m., when the Section will celebrate "130 Years Serving as the Gateway to International Law and Practice". At this Anniversary Dinner, we will present the Section’s Lifetime Achievement Award to Homer Moyer, who, as Section Chair in 1990-1991, was an inspirational leader in the formation of the ABA’s Central European and Eurasian Law Initiative (CEELI), aimed at facilitating the law reform process in that part of the world, and who founded and today serves as President of the Board of Directors of the CEELI Institute, which provides world-class post-graduate skills training for lawyers, judges, and others committed to law reform in countries undergoing democratic transitions. All attendees at the Anniversary Dinner will receive a complimentary copy (retail price $125) of the Section's commemorative history book, which will launch that evening. Don't be disappointed. Well, once again, if you made it this far, you are to be congratulated. The speeches will be shorter, I promise, in Atlantic City and New York. So, I hope to see you there. And remember, whether climbing the Great Wall or strolling the Boardwalk, when you think of the Section, think:

Second Circuit Rules on the Doctrine of “Collective Scienter”

On June 26, 2008, the Second Circuit Court of Appeals issued an eagerly anticipated opinion addressing the use of the doctrine of "collective scienter" in securities fraud cases. In Teamsters Local 445 Freight Division v. Dynex Capital, Inc., No. 06-2902-cv, 2008 WL 2521676 (2d Cir. June 26, 2008), the Second Circuit reversed the district court and held that the plaintiffs failed adequately to allege scienter against corporate defendants Dynex Capital and Merit Securities.

Message from the Section Chair: Stephen Saltzburg

Chair's Video Welcome Message

This August in New York City the Criminal Justice Section’s presence will loom large at the American Bar Association 2008 Annual Meeting. We have a full slate of CLE programs and numerous meetings by a majority of the Section’s various entities.

The Section will take part in presenting programs addressing issues involving these subjects: the most recent research on Miranda warnings and waivers, and the latest scientific findings on how Miranda is delivered and understood; the use of private contractors in Iraq, Afghanistan and elsewhere, and the challenges of appropriately applying and enforcing the rule of law in foreign lands to both governmental officers and private entities and individuals; criminal law cases that came before the Supreme Court during the past term; the criminal justice system’s treatment of adult and juvenile females who appear as offenders or as domestic violence and child abuse victims; preventing seniors from becoming victims of financial exploitation, and prosecuting such cases in the criminal justice arena; and the way technology has changed how judges handle their courtrooms.

On Friday, Aug. 8, District Attorney Charles Joseph Hynes has offered to coordinate tours of the Red Hook Community Justice Center and the Kings County District Attorney's Reentry Program, ComALERT. Attendees will be able to see the Red Hook Community Court and Justice Center and the ComALERT orientation session with recently released parolees up-close and in person. The Brooklyn based event will take place from 10:30 am-2:30pm. If you are interested in attending, please e-mail Myrna Levenhar by Aug. 1.

This project and other diversion programs initiated by the Brooklyn D. A. will receive the Lawyer as Problem Solver Award from the ABA Section of Dispute Resolution at our joint reception that evening. During the reception the Criminal Justice Section will bestow Council member Gary Walker with theMinister of Justice Awardand former Section chair Michael Pasano with the Charles R. English Award.

I take great pleasure and pride in the fact that all three of these prominent public servants will receive their honors during my year as chair. Thus, I personally extend an invitation to each and every Section member to join me at the reception for their moment of recognition for years of contributions to field of criminal law. Joe Hynes and his office and Gary Walker and his office represent the finest in prosecutorial skill, ethics, and commitment to justice. Mike Pasano is the class of the white collar criminal defense bar and a Section member who has shown a willingness to reach across the aisle to improve the state of criminal justice throughout the country.

I would like to close with a little self-promotion. In the latest edition of the Section’s quarterly publication, Criminal Justice, my chair’s column discuss the need for criminal justice issues to be included in the discussions of both parties presumptive nominee for President. We need leadership on these critical issues. Whether or not you have ever read a Chair’s column, I ask you to read this one. Afterwards, you will know why I end this message with a thank you to the members, the staff, and the Council of the Section. You have made my year as Chair special. I could not imagine enjoying it or you more. I am and shall always be grateful.

Feature Publication: International Tax Reform Report

Congressional hearings on the impact of international tax reform on U.S. competitiveness highlight the work of the Tax Section’s Task Force on International Tax Reform. The Task Force recently completed its 200-page white paper, detailing specific objective criteria for evaluating various tax reform proposals and modifications to U.S. international tax rules.

The final report appears in the Spring 2006 edition of The Tax Lawyer, Vol. 59, No. 3, and is available to members and the public here.

Highlights

2008 ABA Annual Meeting
The ABA Annual Meeting will be held in New York City from August 7-12, 2008, with Section activities on August 8-10, 2008. Our Section will be the primary sponsor for the Showcase CLE Program: Climate Change - The Growing Legal Storm, which will provide practical information on how climate change will impact the practice of law. No matter your field of expertise, climate change and its regulation will impact your clients' business, operations, future plans, property, and investments. For more information on all the Section activities during this meeting, please view the Section Annual Meeting page.

16th Section Fall Meeting and The Basic Practice Series
The Section will host two unique continuing education programs in Phoenix, the The ABA Environment, Energy, and Resources Law Summit: 16th Section Fall Meeting and The Basic Practice Series (BPS)—An Introduction to the Practice of Environmental Law. The Section Fall Meeting is where environment, energy, and resources lawyers meet for dialogue on cutting edge topics in the areas of environment, energy, and resources law. For those new to environmental law or wanting a refresher, the BPS sessions will provide an introduction to the practice of environmental law through presentation and discussion of the major federal environmental programs. The brochures for the Section Fall Meeting and BPS are now available!

Model Sustainability Policy
The Section’s Climate Change, Sustainable Development and Ecosystems Committee, with the help of several dozen members, has created a draft Model Sustainability Policy for law organizations. The Model Sustainability Policy and Implementation Guideline show how sustainable development relates to lawyers and their individual firms, corporate law departments, and other law organizations. The tool is designed to allow such entities to show in a meaningful way what they are doing to be good organizational citizens. As of April 2008, eight law firms were piloting this tool…. (more)

ABA-EPA Law Office Climate Challenge

The ABA Section of Environment, Energy and Resources (SEER), in cooperation with the U.S. Environmental Protection Agency (EPA) and co-sponsored by ABA Law Practice Management Section is pleased to present the ABA-EPA Law Office Climate Challenge. The Climate Challenge is designed to encourage law offices to take specific steps to conserve energy and resources, as well as reduce emissions of greenhouse gases - which cause global climate change - and other pollutants.

Law offices may meet the Climate Challenge simply by undertaking best practices for office paper management or by participating in one or more of three EPA partnership (i.e., voluntary) programs.

The Climate Challenge is a two-year pilot project initiated in March 2007.

To enroll, please complete the ABA-EPA Law Office Climate Challenge Enrollment Form, and follow the instructions and submission information included. To submit updates, please use the ABA-EPA Law Office Climate Challenge Update Form. For more information, see ABA-EPA Law Office Climate Challenge.

Buenos diás!

In 2003, the ABA Commission on Law and Aging produced a Spanish version of its most popular consumer brochure "Health and Financial Decisions: Legal Tools for Preserving Your Personal Autonomy."

The Commission also produced a 19-minute Spanish-subtitled version of the video "In Your Hands: The Tools for Preserving Personal Autonomy." The video comes with a program guide that provides sample scripts and discussion points to help present the program. The video is available in DVD and VHS format.

The materials encourage seniors to use legal planning tools to ensure that their personal, health care and financial wishes are honored in the event they become sick, disabled or incapacitated.

They are wonderful tools for attorneys and advocates who work with Spanish-speaking seniors, caregivers, or family members.
